Wal-Mart Being Sued for Obscenity on Evanescence CD ~ 2/13/2005
Wal-Mart portrays itself as selling clean, family friendly music. Not anymore.
This national chain is being sued for selling an Evanescence CD in which one of the songs contained the f-word. The obscenity is heard in a cover of Korn's song "Thoughtless" which is on the bands "Anywhere but Here" CD.
The CD does not feature a parental advisory warning sticker telling potential buyers of any obscenities in the music. Wal-Mart does not sell albums that carry these warnings do to the chain's policy. Therefore, people feel that Wal-Mart is responsible for the vulgarity that they have heard.
The suit seeks an order requiring Wal-Mart to either censor or remove the music from its Maryland stores and damages of up to $74,500 PER the thousands of people who bought the music. The suit also names the band's label, Wind-Up Records, and distributor, BMG Entertainment in the legal action.
The company does not intend to pull the CDs from there shelves as of yet. Spokesman Guy Whitcomb for Wal-Mart stores told the papers, "While Wal-Mart sets high standards; it would not be possible to eliminate every image, word or topic that an individual might find objectionable".
